We offer a free replacement policy if the placement does not work out within the first 4 weeks of arrival. The invoice must be paid before replacement can be found and replacements must be taken within 4 weeks of the original candidate leaving.

Replacement and Rebates guarantee during 12 calendar months from the date of Engagement

 

 

Definitions

“Applicant”                       means the person introduced by the Agency to the Client for an Engagement including any officer or employee of the Applicant if the Applicant is a limited company and members of the Agency’s own staff;

 

“Client”                                 means the person; firm or corporate body together with any subsidiary or associated Company as defined by the Companies Act 1985 to which the Applicant is introduced;

 

“Agency”                           means Simply Recruit Limited of Enterprise House, Harmire Park, Barnard Castle, DL12 8XT

 

“Engagement”                  means the engagement, employment or use of the Applicant by the Client or any third party on a permanent or temporary basis, whether under a contract of service or for services; under an agency, licence, franchise or partnership agreement; or any other engagement; directly or through a limited company of which the Applicant is an officer or employee

 

In order to qualify for Replacement or a Rebate;-

 

1                     The Client must pay the Agency’s fee to Perms Simply within the credit terms of the invoice.

2                     The Engagement is terminated by the Applicant or by the Applicant’s death within the Replacement or Rebate period. (For the benefit of doubt, no Replacement nor Rebate is applicable if the Engagement is terminated by the Client.)

3                     The Client and must notify the Agency in writing of the termination of the Engagement within 7 days of its termination.

 

Exceptions. Rebates will not apply where the Engagement period was contracted to be for less than one year AND termination by the Applicant or by the death of the Applicant did not occur during the Engagement period.

 

Provided  payment is made by the Client and received by Perms Simply within the payment terms on the invoice and the Engagement is terminated by the Applicant or the Applicant’s death then the following  Replacement or Rebate will apply:-

2-6                                              A Rebate of 40% of the fee.

 

7-12                                            A Rebate of 20% of the fee

                TERMS AND CONDITIONS OF BUSINESs relating to both Schedule 1 and 2

These Terms and Conditions shall apply to all business undertaken by Simply Recruit Limited (the Company) for its Clients who, by their granting any Applicant introduced by the Company, an interview, or by Engagement of any applicant (which includes employment or use whether under a contract of service or for services), shall be deemed to have accepted and agreed to be bound by these terms and conditions which may not be modified or varied except with the written agreement of a Director of the Company.

 

 

1.             In the event that an Applicant introduced or provided by the Company, is engaged then a fee will be payable in accordance with the Company’s Scale of Fees plus Value Added Tax or its equivalent.

 

2.             In the event that the Client introduces an Applicant, introduced to the Client by the Company, to another person, firm or corporation resulting in the Engagement of the Applicant by that person, firm or corporation within twelve months of the initial introduction date of the Applicant to the Client, The Client shall pay to the Company a placement fee in accordance with Schedule 1 or 2.

 

3.             Unless otherwise agreed, the Client shall reimburse applicants attending an interview with travelling and out of pocket expenses.

 

4.             The Client shall be responsible for taking up any references (including the confirmation of any professional or academic qualifications) and shall satisfy itself as to the suitability of any Applicant prior to the Engagement of an Applicant by the Client.  The Client shall be responsible for arranging all medical examinations and investigations of the Applicant and shall be responsible for obtaining any work and other permits.  The Company shall have no obligation nor responsibility to the Client in respect of any of the matters contained in this condition.

 

 5.            The Company shall endeavour to ensure the suitability of any Applicant introduced to the Client and to maintain a high standard of service and integrity, but the Company makes no warranty, express or implied, as to the suitability of any Applicant introduced to the Client.

 

 6.            The Company shall not be liable for any loss, liability, damage, costs, claims or expenses suffered or incurred by the Client arising from, or connected with, the recruitment or Engagement of any Applicant by the Client, howsoever arising.

 

 

7.             All monies due shall be paid by the Client within the credit terms shown on the relevant invoice which will normally be 30 days  from the date of invoice. Any discount offered with respect to any invoice is rendered void if such invoice is not settled within its credit terms.
